RULING

This is a demurrer and motion to strike by Defendant Joyce L. Hutchinson Trust, and a demurrer by Defendant Montecito Shores Homeowners Association. On February 3, which is the deadline for filing opposition to the demurrers and motion to strike (Code Civ. Proc., § 1005, subd. (b)), Plaintiff Melinda Bingham filed a first amended complaint. As the timely filing of the first amended complaint by Plaintiff moots the demurrers and motion to strike of Defendants, the Court orders those motions off-calendar and requires Defendants to file their responses to Plaintiff’s first amended complaint on or before February 25, 2026.
