RULINGS

On calendar are four unopposed discovery motions.  

On September 30, 2025, Plaintiff Michael Boyett served on Defendants Thuy Kha and Home Discount 97 Cent Inc.: (1) form interrogatories, set one; (2) special interrogatories, set one; (3) request for production of documents, set one; and (4) requests for admission, set one. Despite numerous extensions, no responses were served on Plaintiff. On January 12, 2026, Plaintiff filed motions to compel responses and to deem matters admitted. No opposition or other response has been filed to these motions.  

The motions to compel are granted to require Defendants to serve verified responses, without objection, to Plaintiff’s (1) Form Interrogatories, Set One, (2) Special Interrogatories, Set One, and (3) Request for Production of Documents, Set One, on or before April 16, 2026.

The motion to deem matters admitted will be granted, and the matters deemed admitted unless Defendants appear at the hearing of this motion and demonstrate that, before the hearing, proposed responses to the requests for admission in in substantial compliance with Code of Civil Procedure section 2033.220 have been served on Plaintiff.  

The motions for awards of monetary sanctions will be granted. Because of the substantial overlap in the substance of the motions and the absence of opposition, the Court awards monetary sanctions for all motions against Defendants Thuy Kha and Home Discount 97 Cent Inc. in the total amount of $3,270, to be paid to counsel for Plaintiff on or before May 1, 2026.
