The following issues must be addressed at the hearing:

Problem with Distribution #1: Decedent was married to Jeanette Grace Greenaway, and named her as the sole heir of the estate, if she survived the Decedent. It is unknown from the current facts before the Court whether Jeanette Grace Greenaway predeceased the Decedent or survived the decedent. Petitioner must appear and be prepared to address the date of death of Mrs. Greenaway, and present a death certificate showing the date of death.

Problem with Distribution #2: If Decedent’s spouse pre-deceased the Decedent, the Last Will and Testament of Decedent devises a specific gift of real property to Decedent’s son, Andrew Greenaway.  From the facts alleged in the Petition for Final Distribution, it appears that specific gift was available upon the death of Decedent, and Petitioner does not explain why the specific gift was sold, instead of distributed.  Petitioner must come prepared to discuss this issue and prove that Andrew Greenaway gave permission for the real property to be sold, instead of distributed outright to him, as the will provides.
