RULING

This is a Demurrer to a First Amended Complaint.

The original complaint was filed on December 6, 2024, and asserts eight causes of action against two Defendants.

On May 2, 2025, without any response having been filed by any Defendant, Plaintiffs filed a First Amended Complaint (FAC), now consisting of two volumes and 575 pages including exhibits, asserting 10 causes of action against the same two Defendants.

On June 25, 2025, the Defendants filed this Demurrer to each of the causes of action of the complaint. On June 27, 2025, Plaintiffs substituted counsel.

On August 18, 2025, on the stipulation of the parties and order of the Court, the hearing on the Demurrer was continued to this date of October 22, opposition was due on September 8, and reply was due on September 18.

Despite the deadlines imposed by the Stipulation and Order, no opposition or reply has been filed (or anything else in this matter since the stipulation).

The absence of opposition suggests that there has been an agreement of some sort that has not been shared with the Court.

The Court has not worked up the Demurrer because it appears that would be futile.
