Tentative Ruling

On March 11, 2025, defendant Victor Tornez-Neri served on plaintiff David Lopez Roman: (1) form interrogatories, set one; (2) request for production of documents, set one; and (3) request for admission, set one. After no responses were received, counsel sent Roman a letter and left a voicemail reminding him of his obligation to serve responses. No responses have been received to date. (Leach decls., ¶¶ 2-5.) Defendant filed motions to compel responses to the form interrogatories and request for production of documents and to deem matters admitted. No opposition has been filed to any of these motions.

The motions to compel responses to the form interrogatories and request for production of documents are granted. Plaintiff David Lopez Roman shall serve verified responses, without objection, on or before September 12, 2025.

Unless before the hearing on this matter plaintiff David Lopez Roman has served a response to the requests for admission that is in substantial compliance with Code of Civil Procedure section 2033.220, the matters stated there in shall be deemed admitted.

Defendant requests, and the court will order, that plaintiff David Lopez Roman shall pay monetary sanctions in the amount of $510.00 for each motion, for a total amount for all motions of $1,530.00. (See Code Civ. Proc., §§ 2030.290, subd. (c), 2031.300, subd. (c), 2033.280, subd. (c).)
