For all reasons discussed herein, Defendant Ford Motor Company’s motion to compel the deposition of plaintiff Randy Kohn is granted. Defendant shall serve a timely notice for this deposition to take place on March 24, 2026, March 25, 2026, or March 26, 2026, as offered by counsel for plaintiff. The court declines to award monetary sanctions. However, if the plaintiff does not attend the deposition after this notice the court will consider appropriate sanctions.

On July 12, 2024, plaintiff Randy Kohn commenced this action by filing his original complaint alleging six causes of action: (1) violation of subdivision (d) of Civil Code section 1793.2 (against defendant Ford Motor Company only [FMC]); (2) violation of subdivision (b) of Civil Code section 1793.2 (against FMC); (3) violation of subdivision (a)(3) of Civil Code section 1793.2 (against FMC); (4) breach of the implied warranty of merchantability (against FMC); (5) negligent repair (against defendant Perry Ford Mazda; and (6) fraudulent inducement – concealment (against FMC). On October 21, 2024, plaintiff filed a first amended complaint alleging the same six causes of action.

The dispute before the court relates to the scheduling of the deposition of plaintiff. The parties have been unable to agree upon a date. Defendant FMC moves to compel this deposition and for sanctions in the amount of $560. FMC argues that plaintiff has not offered alternative dates to several deposition notices, and recently canceled an agreed upon date. Plaintiff argues that his objections were valid and that FMC has not made reasonable efforts to meet and confer over the deposition. Plaintiff has offered the dates of March 24, 2026, March 25, 2026, or March 26, 2026, as noted in his opposition. (Opposition, p. 1, ll. 11-13.) The court will order that this deposition take place on one of these dates. The court declines to award monetary sanctions.
