Defendants Motion to Be Relieved as Counsel.
RULING
1. This is a case filed by Plaintiff and seeks monetary damages more than $95,000 against Defendants on account of unpaid invoices.
2. This is a motion by the attorney for Defendant Hueneme Patient Consumer Collective to be relieved as counsel of record. This was originally set for hearing on 10/23/24, at which time it was continued to 11/20 with instructions for counsel to make corrections, including properly advising the client that a Final Case Management Conference is set for 5/14/25, a Mandatory Settlement Conference is set for 7/11/25, Trial is set for 8/6/25, and inviting counsel to tell the client not only that it will no longer be represented if the motion is granted, but that it cannot be self-represented because it is a limited liability company.
3. The moving party filed an amended motion and supporting declaration and submitted an amended proposed order. The corrections suggested by the Minute Order were made. The motion is based solely on counsel’s statement that Defendant would not voluntarily consent to her request to be relieved as counsel.
4. (The Court notes that the Clerk’s Office, sent moving counsel a Notice of Payment Due, stating that the amount of $180 is due for the original motion and the amended motion—apparently referring to the $90 motion fee for each motion—and noting that if payment was not received on or before 11/8/24, the Court would void the filing of the Amended Motion. The Court assumes the payment was made. Please confirm.)
5. The Motion is GRANTED.
6. The trial date of 8/6/25 and the MSC date of 7/11/25 and the Final CMC Date of 5/14/25 are all confirmed.
7. The next CMC is this case is set for 1/8/25 at 8:30 am to be certain new counsel are on board. The Defendant cannot be self-represented.
