On calendar is a trial confirmation re attorney fees.

RULING

The trial on the issue will commence at 2 pm on 8/6/25.

Analysis

This case was filed on 5/9/24 and answered on 6/13/24.

On 11/5/24 a conditional settlement was announced; it included a promise to file a dismissal of the case by 3/5/25. The dismissal was NOT filed.

On 4/16/24 this Court set a OSC for 6/4/24 to dismiss the case.

On 6/3/25 the parties filed a Joint Stipulation that provided, in part; on November 1, 2024, this matter settled via CCP 998 Offer of Compromise; the Parties are currently meeting and conferring to resolve Plaintiff's attorneys' fees, costs, expenses; the Parties are in agreement the Court should dismiss this case with prejudice and retain jurisdiction pursuant to California Civil Procedure 664.6 to enforce settlement including Plaintiff's attorneys' fees, costs, and expenses and funding of such.

On 6/4/25 the attorney for both parties appeared, and I said: “The Court sets a trial regarding attorney fees for 8/6/25.  No continuances will be granted.”

Unaccountably, even though this Court’s rules provide that trial documents are due one week in advance of the trial, no witness list, no exhibits, no trial briefs have been filed.  

The trial will go forward; the parties have been forewarned.
