On June 18, 2025, defendants Attilio Macrito, D.O., (Dr. Macrito) and Pueblo Radiology Medical Group (Pueblo) filed a motion for summary judgment, in which Pueblo alternatively moved for summary judgment or adjudication as to the issue of Pueblo’s vicarious liability for any purportedly negligent acts of Dr. Macrito. That motion was set for hearing on September 12, 2025. On September 10, plaintiffs filed a request for dismissal of the action, with prejudice, as to Pueblo only. On that same date, Dr. Macrito filed a notice taking Dr. Macrito’s motion for summary judgment off-calendar. As the remaining present motion of Pueblo for summary judgment or adjudication is, for all reasons discussed above, moot based on plaintiff’s dismissal of the action as to Pueblo, the court will order that motion off-calendar.
