Sayma Sultana vs Jamuna-CA Inc et al

Case Number

23CV05288

Case Type

Civil Law & Motion

Hearing Date / Time

Fri, 11/14/2025 - 10:00

Nature of Proceedings

Motions to be Relieved as Counsel

Tentative Ruling

On July 25, 2025, attorney Albert Chang (Chang) filed a motion for an order relieving Chang as the attorney of record for defendant and cross-complainant Lokman Babu, and separately filed a motion for an order relieving Change as the attorney of record for Jamuna-CA, Inc. California Rules of Court, rule 3.1362(e), provides: “The proposed order relieving counsel must be prepared on the Order Granting Attorney’s Motion to Be Relieved as Counsel--Civil (form MC-053) and must be lodged with the court with the moving papers. The order must specify all hearing dates scheduled in the action or proceeding, including the date of trial, if known.” The record reflects that Chang has not lodged with each motion, the required proposed orders in compliance with rule 3.1362. The court also has no record showing that attorney Chang served the clients with the proposed orders, as required by California Rules of Court, rule 3.1362(d). For these reasons, the court will deny the motions, without prejudice to the filing of any procedurally compliant motions to be relieved as counsel that may be filed by attorney Chang in the future.
