Tentative Ruling
On March 29, 2024, defendant Deandra Thompson served on plaintiff Victor Garcia Chavez first sets of form interrogatories, special interrogatories, request for production of documents, and requests for admission. (Biedenweg decl., ¶ 2.) After receiving no responses following multiple communications with counsel, on April 11, 2025, Thompson filed these motions to compel responses to the form and special interrogatories, and to the request for production of documents, together with this motion to deem matters admitted. Each motion seeks an award of monetary sanctions. No opposition or other response has been filed to the motions.
The motions to compel responses to the form and special interrogatories, and to the request for production of documents are granted. Plaintiff Chavez shall serve verified responses to each of those sets of discovery, without objection, on or before August 1, 2025. The motion to deem matters admitted is granted as follows: unless plaintiff has served verified responses to the requests for admission before the hearing on this motion in substantial compliance with Code of Civil Procedure section 2033.220, the matters in the requests for admission will be deemed admitted.
Each motion requests an award of monetary sanctions in the amount of $1,717.50. Because of the substantial overlap in these motions and the lack of opposition, the court awards monetary sanctions against plaintiff Chavez and in favor of defendant Thompson for all motions in the total amount of $825.00, to be paid to counsel for Thompson on or before August 1, 2025.
