Tentative Ruling

By stipulation of the parties and order of the court filed November 17, 2025, the hearing on plaintiff’s motion to compel was continued to January 9, 2026. Remaining on calendar for this hearing is a case management conference (CMC) and a hearing on an order to show cause (OSC) re sanctions. The OSC was issued on October 3, 2025, based upon counsel for plaintiff’s failure to appear at the CMC of that date and failure to file a CMC statement in advance of the CMC. On November 14, Alexander G.L. Davies, counsel for plaintiff, filed a declaration in compliance with the court’s OSC order in response to the OSC. Davies declares that the failures regarding the October 3 CMC were the result of a calendaring error (calendaring October 13 instead of October 3) for which counsel expresses his regret and apology. The court will accept the explanation of counsel, discharge the OSC, and order the OSC off calendar. No appearances are required for this hearing. The CMC set for this date is continued to January 9, 2026, at 10:00 a.m.; new case management statements shall be filed and served no later than 10 days prior to the new CMC date.
