Plaintiff’s counsel has moved to be relieved as his counsel of record in this action, on the basis that the attorney-client relationship has broken down to the point that counsel can no longer act in the client’s best interests. However, the declaration filed in support of the motion fails to provide any information within ¶ 3.b., regarding either having confirmed the client’s address is current, or explaining the efforts which have been made to confirm that the address is current or to locate a more current address. The accuracy of plaintiff’s address is of critical importance to the preservation of his due process rights in this action. While the Court would otherwise be inclined to grant the motion, it cannot do so based upon the deficient declaration submitted in support of the motion. The motion is therefore denied, without prejudice to its renewal on a proper evidentiary showing.
