RULING
The motion of defense counsel Jackson Lewis, P.C. and its lawyers is GRANTED. The trial date of 3/5/25 at 11:30am and the Case Management Conference of 1/8/25 at 8:30 are confirmed. This ruling is expressly different from the “Declaration” of defense counsel who is withdrawing because the Declaration reports the “Trial in this action or proceeding is not yet set.” That is not correct. The March 5, 2025 - Trial Confirmation Conference is “the Trial Date.” Plaintiff will give notice that (1) the Court has granted the motion to withdraw, and (2) the CMC and the Trial Date are confirmed, and (3) the Defendant cannot be self-represented.
The Motion
The Motion to be Relieved as Counsel and Declaration were filed on 10/22/2024. Yvonne Arvanitis Fossati, the lawyer for ACME Labor LLC DBA PRO FARMS moves to withdraw. The Declaration of counsel for ACME states: “The law firm of Jackson Lewis, P.C. and its attorneys are withdrawing from the representation of ACME LABOR LLC dba PRO FARMS ("ACME") pursuant to California Rules of Professional Conduct Rule
1.16(a)(4) because ACME has discharged Jackson Lewis, P.C. and its attorneys from representation.”
Opposition
This is an unopposed motion to be relieved as counsel for Defendant.
The Court’s Conclusions
The motion should be granted. The Defendant needs to be given notice by the Plaintiff that the CMC and the Trial Date are set; that both hearings are confirmed; that the Defendant cannot be self-represented.
