Raquel Orduno Santana v Jessica Lauren McQuinn et al

Case Number

22CV03222

Case Type

Civil Law & Motion

Hearing Date / Time

Wed, 01/17/2024 - 10:00

Nature of Proceedings

Motions to Compel (3)

Tentative Ruling

Plaintiffs: Robert Stoll
Defendant: Richard Gagliano

Issues

Three motions to compel. At the last CMC held on 1/10/2024 the Court confirmed it signed the Stipulation and Order that continues the Trial Confirmation to 7/31/24 and the Settlement Conference to 7/12/24. This motion was not addressed in the Stipulation or the Order.

Ruling

On March 30, 2023, Defendants served Form Interrogatories (Set 1), Special Interrogatories (Set 1), and a Request for Production of Documents (Set 1) on Plaintiff. In spite of multiple contacts with Plaintiff’s attorney, no responses were ever provided. Defendants have now moved to compel responses to the discovery, without objections. The motions do not seek sanctions. Plaintiff has not opposed the motions. The Court will grant the motions, and will order that verified responses, without objections, be served by Plaintiff with respect to the Form Interrogatories (Set 1), Special Interrogatories (Set 1), and a Request for Production of Documents (Set 1), on or before January 31, 2024.
