On September 21, 2015, the court stayed this action on the stipulation of the parties pending disposition of insolvency administration proceedings in Germany. According to counsel for defendant Fair Wheel Bikes (FWB), the stay of proceedings in Germany has been lifted. (Myers decl., ¶ 9.) On July 22, 2025, FWB served a demand for production of documents on plaintiff Kevin Lagan. (Myers decl., ¶ 4 & exhibit A.) No response to the discovery has been received notwithstanding efforts to meet and confer. (Myers decl., ¶¶ 5-8.) On October 14, 2025, FWB filed this motion to compel responses to the discovery request. No opposition has been filed with the court. 

 

As of now, this matter remains stayed by the court’s order of September 21, 2015. The court’s order was based on the disposition of insolvency proceedings in Germany, but has not yet been lifted. Because the stay ceases all proceedings, FWB’s discovery motion is premature and will be denied on that basis. If all parties appear at the hearing of this motion, the court will address the stay at the hearing; otherwise, the court will set a case management conference to address lifting the stay.
