Points and Authorities re: custody.  Declarations of Due Diligence show the petitioner is a stranger to the minor, who appears to have obtained custody of the minor during an exchange with the minor’s mother at a local McDonald’s restaurant. Further briefing is required to show why this Court should not refer this case to the Juvenile Court pursuant to Probate Code section 329 and Welfare and Institutions Code section 329.
