Matter of Jose Flores

Case Number

25PR00483

Case Type

Minor/Disabled Person's Compromise

Hearing Date / Time

Mon, 11/10/2025 - 08:30

Nature of Proceedings

Minor’s Compromise

Tentative Ruling

Probate Notes:

Personal (in-person) appearances required, including the minor. (CRC 7.952.)

The following must be submitted before petition may be approved:

Supplement re: Full Recovery.  The most recent medical records submitted are from May 2024, and do not show full recovery. To the contrary, those records indicate a long journey to full recovery.  Adequate documentation that the minor has fully recovered, or is expected to fully recover from his injuries must be submitted, or a prognosis with an estimate of costs of future care.  The Court cannot determine the reasonableness of the settlement without a realistic outlook of what it will cost to get the minor to full recovery.

Supplement re: Insolvency of Defendant. Because the current settlement amount seems wholly inadequate to compensate the minor for his injuries, adequate evidence of sufficient investigation into the solvency of the settling defendant above the policy limits of the settling insurance company.  There are no facts alleged that defendant cannot meet a judgment past the policy limits.
