Probate Notes:

Appearances required.

On September 2, 2025, Petitioner, Franklin M. Tosti, Jr. filed two petitions with this court.  The first petition was to Determine a Claim to Property, and the second a petition to approve a trust accounting.

Two hearings were held on these petitions, one on October 15, 2025 and the other on December 3, 2025.  For the first hearing, the Petition to Determine Claim to Property was recommended for approval, but does not appear to have yet been approved by the court.  As for the accounting, several notes were posted, outlining discrepancies in the accounting based on the relief requested.

After supplement filed on January 15, 2026, the following is noted for the Court:

Petition to Determine Claim to Property

Petition is still recommended for approval, absent objection.

Accounting

The petition is recommended for approval, absent objection.

Any Respondents desirous to object to the Petition, must file a written objection before the hearing.  The court has authority to require all objectors to file a written objection pursuant CRC, Rule 7.801, or else deem the failure to do so a waiver.

Due to staffing limitations, processing times may be delayed. To assist in processing, attorneys and parties should include the next court date in the “Filing Description” field provided by the electronic service provider. That field is also used for further descriptions of the document being e-filed, so be sure to put the calendar date FIRST in the field – BEFORE any further description of the document being e-filed (e.g.: 06/28/16 For XYZ).
