The following must be submitted before petition may be approved:

Supplement re: Adequate documentation that the minor has fully recovered, or is expected to fully recover from his injuries.  According to the medical records on file, the minor has not fully recovered from his injuries.  Therefore, the attachments supporting the allegation at paragraph 8 of the petition do not support a finding that the minor will fully recover.

Supplement re: Solvency of Defendant.  Adequate evidence of sufficient investigation into the solvency of the settling defendant above the policy limits of the settling insurance company.  There are no facts alleged that defendant cannot meet a judgment past the policy limits.

Supplement re: Medical Expenses.  Petitioner must submit supplement 1) recalculating “total medical expenses before deductions,” and explaining why Medi-Cal has payouts, but has not paid all fees for what appears to be medical treatment. If minor had Medi-Cal, Medi-Cal should have paid for the bulk of minor’s treatment. 

The court will specifically be concerned about all payouts to medical providers that could have been paid by Medi-Cal.  The supplement should explain why any medical care was not paid for by Medi-Cal.
