Hearing Date / Time

Nature of Proceedings

Motion to File FAC

Tentative Ruling

On March 18, 2026, plaintiffs filed this motion for leave to file a first amended complaint. No proof of service is attached to motion or separately filed; no opposition or other response has been filed to the motion. The hearing on the motion is continued to September 28, 2026, at 10:00 a.m. to permit service of the moving papers and any opposition. The case management conference now set for September 28, 2026, at 8:30 a.m. will be continued to 10:00 a.m. to take place concurrently with the motion. Counsel for plaintiffs shall serve notice of this order of continuance, together the moving papers for the motion, and file proof of such service on or before July 20, 2026.

In reviewing the court’s files to find an applicable proof of service, the court also noted that defendants Arroyo Seco Construction, Wyllis Heaton, and Wes Grieger served on July 2 and filed on July 6 a document on entitled, “Proof of Service.” The document does not identify what document was served for which proof is being made; the proof of service attached to the “Proof of Service” merely states that what was served was the “Proof of Service.
