The following defects require continuance of the hearing:

Timely Mailed Notice to Google.  The Proofs of Service attached to the Notices of Hearing filed on January 7, 2026, do not show that Google or its corporate parent, Alphabet Inc., have been served a Notice of Hearing and copy of the motion. The means the requirements for Due Process have not been met, and the hearing must be continued.

Amended Moving Papers.  Movant did not allege compliance with Probate Code sections 876 to 879.3, nor does the Personal Representative’s Declaration include information showing compliance with the pre-requisite actions required by the RUFADAA. The moving papers must be amended and reserved pursuant to CRC, Rule 7.53, to include all actions taken in compliance with Probate Code sections 876-879.3.

It is recommended that the matter be continued to a date to be set by the Court at the hearing, unless the party appears and requests a different date, or submits a request for a different continuance date prior to the hearing. (Local Rule 1721(c)(2)(A-B).) If the matter is continued, documents must be submitted at least 10 days prior to the new hearing date to be considered
