Fraud Alert: Scam Text Messages Claiming DMV Penalties -

We have been made aware of fraudulent text messages being sent to individuals claiming to be from the Department of Motor Vehicles (DMV) or the court system. These messages often state that the recipient owes penalties or fees related to traffic violations or DMV infractions and may include a link or phone number to resolve the matter. 

Take these steps to reduce the chances of falling victim to a text message scam:

  • Never respond to unsolicited or suspicious texts — If you receive a message asking for personal or financial information, do not reply.
  • Verify the source — If you are unsure, always contact the DMV through official channels.
  • Call the DMV if you have concerns — The DMV customer service team is available to help you at 800-777-0133.

Jury Scam alert -

The Santa Barbara Superior Court has received complaints about individuals trying to scam members of the public by pretending to be court officers or officials. The Jury Services office of the Santa Barbara Superior Court does not call citizens to request payments for failing to appear for jury duty. California law does not permit citizens to pay a fine in lieu of jury duty. If you receive such a call simply hang up and, if the scammer persists, call your local law enforcement agency. Appearances required. After supplement filed on October 18th, the following is noted for the Court at the hearing:

Original Will.  Petitioner claims via supplement that the original will was lodged with the court, but did not provide the case number of that lodging for reference. When a will is lodged with the Court, a new case is created and must be related to and subsequent case wherein a petition for probate of that will is filed.  A name search reveals the will was lodged in case no. 24WILL0115.  The cases should be related in the system.

Supplement to the Petition re: Omitted Child.  Petitioner indicated at paragraph 5 of the petition that the Decedent was survived by a daughter, and lists a daughter of the Decedent at paragraph 8 of the petition.  However, that allegation conflicts with the second article of Decedent’s Last Will and Testament, wherein the Decedent attests he has no children. The attachments at 5(a) appear to be a copy of a foreign acknowledgement of the birth of that alleged child, but such documents cannot be admitted into evidence without authentication, and likely without a certified copy from the issuing country. (Evid. Code, §§1520, 1521, 1531.)

Petitioner filed supplement claiming the proposed personal representative will file a petition pursuant to probate code section 11700 as soon as letters are issued, but the Court should schedule the hearing on its own to ensure the issues related to omitted child are resolved early in the case.
