Waivers of Bond

Bond waivers have been the outstanding issue in this case for three hearings.  It is recommended the Court grant the petition without waiving bond, if bond waivers are not on file before the hearing.

Bond must be waived by all adult heirs at law. Petitioner must file bond waivers on Form DE-142/DE-111(A-3e) for all heirs or devisees named in a will, because that is a form mandated by the Judicial Council for use in decedent’s estate cases, and contains statutory notice requirement language that is not contained on the waivers on file that were not on that form.
