Any Respondents desirous to object must file a written objection before the next hearing.  The court has authority to require all objectors to file a written objection pursuant CRC, Rule 7.801, or else deem the failure to do so a waiver. 

The following is noted for the Court at the hearing:

Petitioner requests title to several bank accounts be confirmed in the name of the trust, pointing to Schedule A of the trust as evidence of the settlor’s intent to hold said properties in trust.  However, Schedule A of the trust plainly excludes bank accounts with designated beneficiary clauses with the following language:

“All banking, investments, securities, retirement accounts and life insurance policies, unless otherwise given by way of beneficiary.” (Pet. at exh. B, dig. p. 17.)  There are no allegations within the petition that the subject accounts do not have a designated beneficiaries clause. The petition is recommended for denial unless Petitioner submits proof that the subject accounts do not have a designated beneficiaries clause.  Proof may be submitted via verified supplement.
