The following is noted for the court at the hearing:

Defective Proof of Service of Notice of Hearing.  Notice to David A. Nielsen is defective.  Notice must be given 15 days prior to hearing on Judicial Council Form DE-120, served on all known heirs and devisees, as well as on the Personal Representative (if not the petitioner) and special notice requestors.  (Prob. Code, §§ 11601 & 1220.) Notice must be sent to the person, not the person’s representative. (§1220.)  The Proof of Service here was filed on POS-030, which does not contain the language and warnings required by the Probate Code.

This issue can be resolved by the appearances of Mr. Nielson at the hearing.
