Tentative Ruling

On January 28, 2025, plaintiff Global Assets Liens & Foreclosures, Inc. requested, and the court entered, default as to defendant Alpha Core Inc. (Alpha). On February 20, 2025, defendant Alpha filed its motion to set aside the entry of default, which is set for this hearing of May 12. Neither the motion nor declaration in support of the motion attach a proof of service; no proof of service of the moving papers has been filed since. “Proof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing.” (Cal. Rules of Court, rule 3.1300(c).) No opposition or other response has been filed. The motion must therefore be continued to permit or to show service.

            Also, on April 28, 2025, there was a case management conference (CMC) in this matter at which no counsel appeared. The court continued the CMC to this hearing date, with the clerk giving notice to counsel by mail.

            Both the hearing on the motion to set aside default and the CMC are continued to July 21, 2025, at 10:00 a.m. Counsel for defendant Alpha shall serve its motion and supporting papers together with notice of this ruling, and file proof of service of all such documents with the court on or before May 21, 2025. Opposition and reply papers for the motion to set aside default, and CMC statements, are to be filed by the deadlines provided in the Code of Civil Procedure and California Rules of Court based upon the July 21 hearing.
