Jury Scam alert -

The Santa Barbara Superior Court has received complaints about individuals trying to scam members of the public by pretending to be court officers or officials. The Jury Services office of the Santa Barbara Superior Court does not call citizens to request payments for failing to appear for jury duty. California law does not permit citizens to pay a fine in lieu of jury duty. If you receive such a call simply hang up and, if the scammer persists, call your local law enforcement agency. Tentative Ruling

The following deficiencies persist:

1. Proof of Publication. Jurisdiction of the Probate Court is obtained by publication in accordance with Probate Code section 8121. (Prob. Code, § 8003(b).) No proof of publication was filed. Publication requires the notice to be published in newspaper adjudicated as a newspaper of general circulation in the city of decedent’s residence. (Prob. Code, §§ 8121, 7122.) A declaration of substantial compliance is required. (Prob. Code, § 8122.)

2. Supplement to the Petition. The following allegations must be made without creating ambiguity, but were left blank or improperly alleged and must be corrected by supplement:

- Paragraph 5a(3) or (4)

- Paragraph 5a(7) or (8)

3. Proposed Order (Form DE-140). A proposed order must be submitted with relief that matches that requested in the petition. No such document was filed with the court. Proposed Orders must be filed no later than 5 days before the hearing. (See Local Rule 1724 (b).)

Please submit any documents curing these deficiencies by Monday 5:00 p.m. prior to your Thursday hearing date. Otherwise, it’s likely the Court will not have time to review the documents and your matter will be continued at the hearing.
