Fraud Alert: Scam Text Messages Claiming DMV Penalties -

We have been made aware of fraudulent text messages being sent to individuals claiming to be from the Department of Motor Vehicles (DMV) or the court system. These messages often state that the recipient owes penalties or fees related to traffic violations or DMV infractions and may include a link or phone number to resolve the matter. 

Take these steps to reduce the chances of falling victim to a text message scam:

  • Never respond to unsolicited or suspicious texts — If you receive a message asking for personal or financial information, do not reply.
  • Verify the source — If you are unsure, always contact the DMV through official channels.
  • Call the DMV if you have concerns — The DMV customer service team is available to help you at 800-777-0133.

Jury Scam alert -

The Santa Barbara Superior Court has received complaints about individuals trying to scam members of the public by pretending to be court officers or officials. The Jury Services office of the Santa Barbara Superior Court does not call citizens to request payments for failing to appear for jury duty. California law does not permit citizens to pay a fine in lieu of jury duty. If you receive such a call simply hang up and, if the scammer persists, call your local law enforcement agency. Notice to Jurors:

The following is noted for the court at the hearing:

Discrepancy no. 1 – Missing Schedules.  The accounting does not have Schedules supporting 1) losses on sale and/or gains on sale; 2) Estate on hand at end of account listing property on hand; or 3) Changes in the form of assets. (Prob. Code, §1063(a).)

Discrepancy no. 2 – The estate is losing money at a rate that will not support the conservatee past 2026. The following causes are readily identifiable from the schedules:

  • Residential Care Facility
  • Unnecessary expenditures (IStorage)

Discrepancy no. 3 – Schedule C totals do not match entries. The General Administration Expenses (GC-400(C)(5)) schedule totals $ 14,398.06, but is subtotaled at $20,521, a difference of $6,122.94.

Discrepancy no. 4 – Several unusual expenditures were not explained.  A supplement to the petition must be filed explaining the following unusual expenditures, including the nature and purpose of the expenditure in sufficient detail to allow the court to analyze the necessity of the expenditure (Prob. Code, § 1064(a)(2)):

Discrepancy no. 5 – Closing escrow statement must be provided for all sales of real property. There is no escrow statement on file.

Discrepancy no. 6 – No allegations re: Investigation Fees.  “In cases involving a court investigation, a petition for approval of an account must state the amount of court investigator's assessments that have been paid and any amount due and owing. A receipt for payment must be filed, unless the fiduciary has obtained an order deferring or waiving payment of the assessment.” (Local Rule 1741)
