There are two active petitions for relief in this case.
The first in time is a Petition for Internal Affairs and Instruction, filed by Ms. Aguilar on May 19, 2023, and Amended on July 28, 2023. A written objection to this petition was filed by James Hauck on October 2, 2023, placing this matter at issue and requiring evidentiary hearing to resolve. (In re Estate of Lensch (2009) 177 Cal.App.4th 667, 676; Conservatorship of Farrant (2021) 67 Cal.App.5th 370, 377.)
The second in time, and only petition on for this hearing, is an unserved Petition to Remove the Trustee and Substitute in a New Trustee, filed by James Hauck on February 2, 2024. An objection to this petition was filed on March 8, 2024, placing this matter at issue and requiring evidentiary hearing to resolve. (In re Estate of Lensch (2009) 177 Cal.App.4th 667, 676; Conservatorship of Farrant (2021) 67 Cal.App.5th 370, 377.)
The Court has already referred this matter to our settlement master for arbitration, and schedule a case management conference for June 3, 2024. It is recommended the court continue this hearing to the June 3rd date to be heard in conjunction with the other petition.
