Lilly Teisher vs Steven R Andrade et al

Case Number

23CV04374

Case Type

Civil Law & Motion

Hearing Date / Time

Fri, 01/10/2025 - 10:00

Nature of Proceedings

Motion: Entry of Judgment

Tentative Ruling

At a hearing on August 30, 2024, the Court sustained the demurrer by defendant Regents of the University of California (Regents), without leave to amend, to the only causes of action alleged against it. While the Court’s Minute Order specified that the complaint was dismissed as to the Regents, the formal order submitted by the Regents, and executed by the Court, did not include the dismissal. Defendant Regents has now moved for formal dismissal of plaintiff’s action against it and entry of judgment in its favor, pursuant to the terms of Code of Civil Procedure section 581(f)(1). That statute entitles Regents to dismissal of the action against it, under the current circumstances. The motion is therefore granted, and this action is ordered dismissed with respect to defendant Regents, and judgment entered in Regents favor. The Court has reviewed the proposed Judgment of Dismissal submitted by the Regents, and intends to execute it.
