This is a motion by two of the defendants Pico Rivera First Mortgage Investors, LP, and Mortgage Co. of Santa Barbara, Inc., for an order severing for trial certain defenses to plaintiff’s third amended complaint and the question of whether evidence of an insurance payment received from defendant First American Title Insurance Co., in settlement, constitutes payment from a collateral source. Defendant First American Title Insurance Co., has filed a motion for summary judgment which is set for hearing on October 27, 2025. As the disposition of First American’s motion may have an impact on the resolution or determination of the present motion to sever, the hearing on the motion to sever will be continued to October 27, to allow that motion to be heard concurrently with First American’s summary judgment motion.
