Nature of Proceedings

Compliance Review Hearing; Review: Investigator's Report

Tentative Ruling

This matter was set for hearing upon appointment of the conservator to ascertain whether the conservator has complied with certain obligations and for review of the Court Investigator’s report.

As to the statutory obligations, the following must be submitted: Proof of Service – Notice of How to File Objection to I & A (GC-042) (Prob. Code, § 2610) The Inventory & Appraisal (Form GC-040) must be sent along with the GC-042 form that provides information to interested parties of their right to object to the Inventory & Appraisal. BOTH, the Inventory & Appraisal (Form GC-040) and the Notice of how to File Objection (Form GC-042) must be mailed to the conservatee, the conservatee’s spouse, and the conservatee’s parents and adult children. Here, upon review of the filed documents there is nothing indicating that the GC-040 was sent.

As to the Court Investigator's Report, the court has received and reviewed the report of the Court Investigator and it appears appropriate for approval.

Absent objection, the matter will be approved.

The next review hearing will be held on: 09/25/2025 in SB Dept 5 of this court at 9:00 AM.
