The current petition for Temporary Conservator filed on August 20, 2024, received a written objection, filed by Kimberly Evenson. This places the matter at issue, requiring evidentiary hearing to resolve. (In re Estate of Lensch (2009) 177 Cal.App.4th 667, 676; Conservatorship of Farrant (2021) 67 Cal.App.5th 370, 377.)
The following must be submitted:
McConnell Petition
Professional Fiduciary Attachment. Petitioner is a Private Professional Fiduciary, which is required to submit a proposed hourly fee schedule or another statement of compensation, a statement of proposed conservator’s license and registration information, and a statement explaining how petitioner was engaged (see Prob. Code, § 2250, subd. (c)), all of which are satisfied by attaching GC-210 (A-PF) to the petition. Supplement must be submitted with the attachment.
Proof of Personal Service of Citation. In a conservatorship proceeding, jurisdiction is obtained through personal service of a citation and a copy of the petition for conservatorship upon the proposed conservatee. The notice must be personally delivered to the proposed conservatee at least 5 court days before the hearing. A copy of the petition for temporary appointment shall be served with the notice of hearing. (Prob. Code, § 2250(e)(2).) There is no Proof of Service of the citation on file.
Proof of Service to Public Guardian. If the petition states that the petitioner and the proposed conservator have no prior relationship with the proposed conservatee (usually private professionals) and has not been nominated by a family member, friend, or other person with a relationship to the proposed conservatee, notice of hearing shall be served on the public guardian of the county in which the petition is filed. [Prob. C. § 2250(e)(2)]
