Appearances are required. The court understands plaintiffs’ goal of adding factual allegations to support an allegation that the exposure is injurious to health in addition to the currently existing allegations in support of the nuisance claim. Plaintiffs should be prepared to discuss whether adding a separate cause of action for violation of section 3479 is duplicative of the existing nuisance causes of action and whether amendment of the nuisance cause of action would be the better approach. 

The parties are instructed to appear at the hearing for oral argument. Appearance by Zoom Videoconference is optional and does not require the filing of Judicial Council form RA-010, Notice of Remote Appearance.
