Defendant Kone Inc.’s Motion for Determination of Good Faith Settlement between Defendant Kone Inc. and Plaintiffs Jamison Moore, Jackson Moore, and Derek Moore

Tentative Ruling

On March 5, 2026, defendant Kone Inc. (Kone) filed this motion for determination of good faith settlement between defendant Kone and plaintiffs (Settlement).

On April 24, the court continued this motion to June 26. The court ruled in part: “Because the Settlement involves the compromise of a minor’s claim in this action that has not yet been approved by the court, the settlement is not yet final…. The court will continue this motion to June 26, 2026. If the Settlement is approved on or before June 26, the court will fully address Kone’s motion on its merits at the June 26 hearing.”

On June 26, the court continued this motion to this hearing, ruling in part: “The court has not received any filings pertaining to the minor’s compromise. The court will continue this motion to September 4, 2026, in this department at 10:00 a.m. If the supporting papers for the minor’s compromise are not filed on or before August 7, 2026, the court will order this matter off calendar.”

The court has not received any additional filings pertaining to the minor’s compromise. For all the foregoing reasons, this motion is ordered off-calendar, subject to being reset after the minor’s compromise has been approved.
