Any Respondents desirous to object to the Petition, must file a written objection before the hearing.  The court has authority to require all objectors to file a written objection pursuant CRC, Rule 7.801, or else deem the failure to do so a waiver.

Petitioners requested Mr. Vanderkelen (herafter “trustee”) account from January 2023 to December 2023.  This request was made November 4, 2024.  Trustee provided the accounting, then Petitioners went back and forth via email with the trustee on various concerns raised by the petitioners about the accounting that was provided.

At no time after the accounting was delivered did petitioners make an additional request for an accounting.

Therefore, Petitioners have not met their burden to show the Trustee failed to provide an accounting pursuant to a proper request via 17200(b)(7)(C), and their petition should be DENIED.
