The following is noted for the Court at the hearing:

Discrepancy no. 1 – Conservator paid $6,997.01 for investment advisory fees over the accounting period. There appears to have been excessive trading performed that generated these fees.  Conservator should explain why the number of securities transactions were necessary and the amount of fees paid should be taken into account when determining the reasonableness of the conservator’s fees.

Discrepancy no. 2 – Several unusual expenditures were not explained.  A supplement to the petition must be filed explaining the following unusual expenditures, including the nature and purpose of the expenditure in sufficient detail to allow the court to analyze the necessity of the expenditure (Prob. Code, § 1064(a)(2)):

Discrepancy no. 3 – There are two payments to Citicard.in 2024, long after conservatorship was established.  Conservator may not use credit cards without disclosing the billing statements to the court. Use of credit cards without court approval violates CRC, Rule 7.1059, subdivisions (b)(1-3, and 8).

Discrepancy no. 4 – Payments to Comcast total $4,803.75. Conservator must explain why a tv/cable/internet bill is so high on a monthly basis.  Conservator also must explain why there are similar charges accounted for in the Trust Accounting during the same time period.  Between June 2023, and August 2024, $2,964.61 in payments were also made to Comcast from the trust.
