Jury Scam alert -

The Santa Barbara Superior Court has received complaints about individuals trying to scam members of the public by pretending to be court officers or officials. The Jury Services office of the Santa Barbara Superior Court does not call citizens to request payments for failing to appear for jury duty. California law does not permit citizens to pay a fine in lieu of jury duty. If you receive such a call simply hang up and, if the scammer persists, call your local law enforcement agency. Court records show that an Accounting is due (See Prob. Code § 2620), but there is no accounting on file. At the September 21, 2023 hearing the Court granted a continuance as requested by counsel.

The Letters of Guardianship issued on 11/16/2021 state the guardianship expired on 05/24/2023. The petitioners may submit a waiver of account and final report.

Under Probate Code, section § 2627(a), a minor who has reached the age of majority may release the Guardian and settle accounts. If the ward waives the account, Cal. Rules of Court, rule 7.1004(c), requires a Guardian of the estate whose administration is terminated by operation of law to submit a final report of the administration. However, the Guardian of the estate is not entitled to a discharge until 1 year after the minor has reached majority. (Prob. Code, §2627(b).)

Therefore, petitioner must submit either:

1. The 1st Account and Report for the court’s review; or,

2. A waiver to account signed by the ward along with a final report of the administration.
