On March 18, 2025, plaintiffs Rancho Las Cruces, LLC, et al., filed a notice of conditional settlement of the entire case stating that a request for dismissal would be filed no later than October 18, 2025. After significant further litigation notwithstanding this notice of settlement, on April 13, 2026, the court set a trial date of July 6, 2026. On June 3, 2026, plaintiffs filed this motion to vacate the March 18, 2025, notice of settlement. On June 29, 2026, plaintiffs filed a new notice of conditional settlement of the entire case stating that a request for dismissal would be filed no later than December 29, 2026. In response to the notice of settlement, the court vacated the trial date and set an order to show cause re dismissal for October 5, 2026, at 8:30 a.m.

As this sequence makes clear, plaintiffs filed two notices of settlement, one on March 18, 2025, and one on June 29, 2026. The June 29, 2026, notice clearly supersedes the March 18, 2025, notice. Because this motion seeks to vacate the March 18, 2025, notice, this motion was mooted by the later-filed June 29, 2026, notice of settlement. The motion to vacate is therefore ordered off calendar.
